SUMMARY
Starting from an article by the then president of the Provincial Court of Seville, the author reflects on shared custody and the role of social workers. She reviews the framework of Article 92 of the Civil Code following Act 15/2005 —which strengthens shared parental responsibility but leaves matters such as housing or maintenance unresolved— and recalls that the judge may seek expert reports to determine the custody arrangement best suited to the child's interests. This is where social work contributes: the forensic social report offers a concrete account of the relevant social factors. She proposes categories of analysis —socio-family system, networks, habitat and housing, employment, social skills and finances— comparing the situation before and after the break-up, and concludes that the report provides professional, objective and impartial criteria that underpin the court's decision.
